Andrea M. Kirshenbaum litigates employment discrimination matters, both in court and at the administrative agency level, including matters under the ADEA, Title VII, the FMLA, the ADA, 42 U.S.C. Section 1981, 42 U.S.C. Section 1983, ERISA, the Pregnancy Discrimination Act and the PHRA. Ms. Kirshenbaum has litigated matters including cases alleging failure to hire, failure to promote, disparate treatment, harassment, retaliation and termination as well as cases alleging state law contract and tort claims and non-compete and employee raiding cases. She also provides counseling to clients. Outside of the employment realm, Ms. Kirshenbaum has litigated several alleged public accommodation discrimination matters. She also has experience litigating FLSA and state wage and hour claims, including experience with collective and class actions.
Ms. Kirshenbaum served as a law clerk to the Honorable Morton I. Greenberg of the U.S. Court of Appeals for the Third Circuit and to the Honorable Harvey Bartle III, Chief Judge of the U.S. District Court for the Eastern District of Pennsylvania.
Ms. Kirshenbaum is a 2001 cum laude graduate of the University of Pennsylvania Law School, a graduate of the University of Pennsylvania Graduate School and a cum laude graduate of Duke University.
