Andrew T. Hahn practices in the areas of litigation and employment law. Mr. Hahn's practice focuses on commercial litigation matters involving contract disputes, including franchising, insurance and software licensing matters, as well as class actions relating to products liability and toxic torts, securities, antitrust, bankruptcy and banking. He also has experience in patent litigation and matters involving complex technology.

Mr. Hahn has particular experience in matters involving executive compensation and issues related to trade secrets and restrictive covenants. He is certified as a neutral for the American Arbitration Association.

Mr. Hahn is a 1986 graduate of Cornell Law School as well as a graduate of Cornell University (A.B., cum laude) and Marymount University (M.B.A.).

Representative Matters

  • Represent defendant insurance company against auto body shop claiming millions of dollars in damages due to hourly labor rates allowed for collision repairs. M.V.B. Collision, Inc. v. Allstate Ins. Co., Civil Action No: 07-cv-00187 (E.D.N.Y.) (JFB) (MLO).
  • Represented defendant tenant in alleged breach of commercial sublease. Obtained complete victory for client, including award of attorneys' fees pursuant to a prevailing-party provision. Health Insurance Plan of Greater N.Y. v. Photobition N.Y., Inc., 65 A.D.3d 401, 884 N.Y.S.2d 713 (1st Dep't 2009).
  • Represent defendant insurance company in putative class action to recover penalty interest under New York "No Fault" Insurance Law. Motion to dismiss for failure to state a claim granted with prejudice and affirmed. U.S. Supreme Court reversed on Erie doctrine. Galvez and Shady Grove v. Allstate Ins. Co., 466 F. Supp. 2d 467 (E.D.N.Y. 2006), aff'd, 549 F.3d 137 (2d Cir. 2008), rev'd, 130 S. Ct. 1431 (2010) (4-1-4 split).
  • Represented defendant accounting firm in age discrimination case. Summary judgment dismissing complaint granted. Brollosy v. Margolin, Winer & Evens, LLP, 04-CV-0873 (DRH) (ARL) (E.D.N.Y. 2006).
  • Represented defendant medical supplier in a class action lawsuit for injuries allegedly suffered by medical professionals, including hospital technicians and nurses, as a result of wearing latex gloves. Achieved dismissal on lack of product identification grounds. In re Latex Glove Product Liability Litig. (Sup. Ct. N.Y. Co.).
  • Represented defendant, a former manufacturer of a blood-clotting drug, in a class action lawsuit commenced by hemophiliacs who contracted HIV/AIDS. Achieved dismissal on standing and lack of product identification grounds. In re Factor Concentrate Product Liability Litig. (N.J. Law Div.).
  • Represented chemical company in ongoing litigation pursued by a class of U.S. and Korean veterans as well as by Vietnamese nationals arising out of the use of the defoliant Agent Orange during the Vietnam War. In re Agent Orange Product Liability Litig., MDL 381 (E.D.N.Y.).
  • Represented certain employee defendants in securities class action involving restatement of financial statements. Employees dismissed from the case. In re Hayes Lemmerz International (E.D. Mich.).
  • Represented underwriter in securities fraud class action alleging material misrepresentation in a prospectus of an initial public offering case settled on terms the client found favorable. In re Nanophase Technologies, Inc. (N.D. Ill.).
  • Represented savings bank in action to recover funds it alleged were embezzled by the defendants.Abacus Federal Savings Bank v. Lim, Index No. 108378/03 (Sup. Ct. N.Y. County).
  • Represented defendant in restrictive covenant and misappropriation of trade secrets case brought by his former employer; preliminary injunction denied; case dismissed) Conopco, Inc. v. Lam, Index No. 110522/03 (Sup. Ct. N.Y. Co.).
  • Represented data-center software company in action for breach of a software-licensing agreement against designer of the software; case settled on terms the client found favorable. Software Engineering of America v. SBB Software GmbH, AAA Case No. 50 T 117 00575 03.
  • Represented defendant staffing-services firm in an action for breach of franchise agreement brought by franchisee; settled on terms the client found favorable. Hersh v. Robert Half Inc., AAA No. 13 Y 114 02146 02.
  • Represented defendant former employee in restrictive covenant and misappropriation case; preliminary injunction denied; case dismissed. Venture Direct Worldwide v. Keane, 601725/01 (Sup. Ct. New York County 2001).
  • Represented defendant retailer in gender and disability discrimination case brought by a manger of the store; summary judgment granted in favor of defendant. Orlowski v. Sears, Roebuck and Co., 99 CV 0128 S(F) (W.D.N.Y. 2000).
  • Represented plaintiff executive in breach of contract case brought against former employer and principal of the company. Succeeded in establishing principal's alter ego in state court, obtained arbitration award before AAA, enforced award in state and bankruptcy courts. Palmer v. Parrish, AAA Case No. 13 160 00244 97 (1996-2001).
  • Represented defendant former executive in an action for breach of restrictive covenant in an employment agreement commenced by employer, a retail store of designer menswear; preliminary injunction denied. Bijan Designer For Men, Inc. v. Katzman, No. 96 Civ. 2345 (BSJ) (S.D.N.Y.).
