Daniel Ginzburg is an associate in the firm's Newark office where he is a member of the Trial and Appellate Practice Groups. His practice focuses on commercial litigation, banking and financial services litigation and consumer litigation. He has substantial experience with complex residential and commercial foreclosure actions, various state consumer fraud laws, minority shareholder statutes, actions under the Uniform Commercial Code including Articles 3 and 9, title insurance claims, bankruptcy adversary proceedings, consumer class actions, and product liability claims. Mr. Ginzburg has litigated cases under the Truth-In-Lending Act, the Fair Credit Reporting Act, the Real Estate Settlement and Procedures Act, the Telephone Consumer Privacy Act, the Fair Debt Collection Practices Act and their state counterparts.
Mr. Ginzburg has litigated cases throughout the country. In addition to appearing frequently in the jurisdictions of New York and New Jersey, he regularly works on matters in the Commonwealth of Pennsylvania.
In addition, Mr. Ginzburg has represented clients in such diverse fora as the International Chamber of Commerce (ICC), the International Center for Dispute Resolution (ICDR), the London Court of International Arbitration (LCIA) and the International Center for the Settlement of Investment Disputes (ICSID). His experience includes serving as counsel in disputes involving a range of industries, including financial services, natural gas extraction, lodging and marine transport.
Mr. Ginzburg also has experience representing clients in connection with the Foreign Sovereign Immunities Act, international anti-suit injunctions, the Foreign Corrupt Practices Act, the Hague Service and Evidence Conventions, the Uniform Foreign Country Money Judgments Recognition Act, the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the "New York Convention") and others.
Mr. Ginzburg received his J.D. from St. John's University School of Law in 2007. While in law school, he served as articles and notes editor of the St. John's Law Review and as a judicial intern for the Hon. Kevin N. Fox (S.D.N.Y.), the Hon. William H. Pauley III (S.D.N.Y.) and the Hon. Joseph M. McLaughlin (2d Cir.).
Prior to attending law school, Mr. Ginzburg served in the United States Marine Corps and attained the rank of sergeant. He is fluent in Russian.
Representative Matters
- Obtained on behalf of a client dismissal of a unique adversary proceeding in bankruptcy in which the trustee alleged the existence of a "Ponzi-like scheme" arising out of a series of fraudulent leasing transactions.
- Obtained on behalf of a client a ruling from the Superior Court of Pennsylvania that state law negligence and defamation claims arising from information furnished to credit reporting agencies are preempted by the federal Fair Credit Reporting Act.
- Completed on behalf of a client acting as trustee for an investment fund the foreclosure of a $65 million mixed-use condominium project in central New Jersey.
