James J. Halligan practices in the areas of trial and litigation. He is an experienced trial lawyer and has served as trial counsel in numerous complex state and federal commercial cases across the United States involving a variety of subject matters, including intellectual property litigation, contracts, covenants not to compete/restrictive covenants, trade secrets, business torts, medical payor/reimbursement disputes, banking and financial litigation, manufacturer-distributor disputes, products liability, and real estate disputes and transactions. Mr. Halligan frequently represents clients in federal and state court proceedings in which injunctions or temporary restraining orders are sought to enforce non-compete agreements, preclude the theft of trade secrets and otherwise protect intellectual property rights. Mr. Halligan has significant courtroom experience and has represented clients at the appellate level in both state and federal courts. 

Mr. Halligan is a 2010 graduate of Temple University Beasley School of Law, where he was a research and articles editor of The Temple Journal of Science, Technology and Environmental Law. While at Temple Law, Mr. Halligan served as a judicial intern for the Honorable Cynthia M. Rufe of the Eastern District of Pennsylvania. Mr. Halligan is also a graduate, with highest distinction, of the Pennsylvania State University.

Prior to enrolling at the Pennsylvania State University, Mr. Halligan served as an engineer in the United States Army.

 

Representative Matters

  • Represented a cable and electrical component manufacturer defending claims that its sales people and advertising made false claims about its products to consumers.

  • Obtained dismissal of multi-million dollar trade secret misappropriation claim filed by competitor against international automotive parts manufacturer.

  • Obtained an injunction and other relief on behalf of a Fortune 500 international software and service provider against a former high-ranking executive and one of the world’s largest software developers as a result of the former executive’s misappropriation of trade secrets.

  • Obtained favorable result on behalf of a heat map manufacturer in suit filed against a competitor who falsely misrepresented the quality of its own product and the client’s product to unfairly compete.

  • Won a trial judgment before the Trademark Trial and Appeal Board in opposition to trademark registration that infringed on the trademark of a national restaurant chain.

  • Obtained an injunction and favorable resolution on behalf of an international trucking and transportation company against a former high-level sales employee that misappropriated the company’s trade secrets and confidential customer information and engaged in unfair competition.

  • Obtained highly favorable settlement in favor of national mortgage bank against a competitor bank that prevented the competitor bank from engaging in corporate raiding, theft of confidential information, unlawful solicitation, and other unfair business practices.

  • Obtained an injunction on behalf of a national mortgage bank against a former high ranking employee as a result of the employee’s misappropriation of confidential and trade secret information and unlawful solicitation.

  • Obtained an injunction on behalf of auditory and hearing device manufacturer against a former high level executive that prevented the former executive from unlawfully competing against the company and using or disclosing confidential trade secrets.

  • Successfully defended numerous cases on behalf of a prominent bank that were consolidated in the U.S. District Court for the District of Delaware seeking damages for mortgage loans issued to borrowers in excess of the value of collateral resulting from alleged malpractice by a real estate appraising company.

  • Obtained dismissals of product liability claims against the parent company of medical device manufacturer in multiple lawsuits filed in several states.

  • Obtained a favorable settlement for a national mental health services provider for unpaid Medicaid reimbursements.

  • Successfully defended against claims for injunctive and other relief against a prominent Community Civic Association based on allegations of misuse of monies paid to the Association as part of its agreement with a casino group.

  • Obtained a dismissal of educational malpractice claims filed against University client.

  • Obtained favorable resolutions on behalf of pharmaceutical packaging manufacturer in multiple lawsuits filed by industrial machine suppliers.
