Julie A. Vogelzang is an employment and business law attorney with a focus on wage and hour compliance and litigation. She has defended large, medium and small companies sued in class actions for alleged wage and hour violations, including misclassification and overtime cases, meal and rest break cases, background check cases, pregnancy/child care leave violations, and independent contractor status cases. Ms. Vogelzang is the leader of Duane Morris' California team of lawyers who focus on class actions.

Ms. Vogelzang also defends companies and management accused of wrongful termination, discrimination, harassment, retaliation and unfair competition. She performs wage and hour audits, defends companies in claims presented to governmental agencies, provides legal advice to companies undertaking small and massive layoffs, conducts investigations into employee complaints, counsels employers on preventive practices and policies, and provides harassment, management and performance training.

Prior to entering private practice, Ms. Vogelzang served as law clerk to the Honorable William B. Enright of the U.S. District Court for the Southern District of California.

Ms. Vogelzang is a 1994 cum laude graduate of the University of San Diego School of Law, where she was editor of the Law Review and elected to the Order of the Coif, and a graduate of the University of Virginia.

    Corporate/Intellectual Property Matters

  • Lead trial lawyer for major financial institution in jury trial concerning trade secret misappropriation. After a 7-week trial in California Superior Court in San Bernardino County, the jury found that the client was not liable for trade secret misappropriation.
  • Class/Collective/Governmental Actions

  • Represented international transport company in California wage and hour class action.
  • Represented social security services firm in California in wage and hour class action.
  • Represented nation-wide accredited school in wage and hour class action in California; class claims dismissed.
  • Represented chain of grocery stores in wage and hour class action in California.
  • Represented west-coast based post-secondary accredited school in wage and hour class action in California; class claims dismissed.
  • Represented a post-secondary school operating in California, Nevada and Arizona in a Fair Labor Standards Act collective action.
  • Represented a post-secondary school in California in a wage and hour class action; case dismissed with prejudice.
  • Represented a textile company in federal court in a California wage and hour class action, where drivers alleged they were entitled to back overtime and wages for missed meal and rest periods.
  • Represented 22 restaurants in California wage and hour class action where employees alleged they were entitled to back overtime and wages for missed meal and rest periods.
  • Represented post-secondary educational facility in federal court in a California and nationwide class action case in which the class members alleged fraudulent business practices concerning purportedly false representations.
  • Represented two residential care facilities in audits by the Department of Labor concerning alleged non-compliance with the FLSA laws regarding minimum wage, overtime, pay and related laws.
  • Represented a large California interior design company in a class action in California state court in which the plaintiffs alleged they were misclassified as exempt employees and were entitled to overtime during the previous four years.
  • Represented a national fast food chain in a class action in which plaintiffs alleged violations of California's wage and hour laws relating to pay and travel issues.
  • Represented a large national insurance company in a class action in federal court for alleged pregnancy disability violations and for alleged sick leave violations.
  • Discrimination, Harassment and Related Matters

  • Prevailed on a motion for summary judgment and appeal in a case in which 27-year employee alleged seven claims for discrimination, retaliation, breach of contract, invasion of privacy, emotional distress and related claims.
  • Represented an international semiconductor company in a federal lawsuit alleging claims for disability discrimination, age discrimination, retaliation, wrongful termination, breach of contract and intentional infliction of emotional distress. Plaintiff dismissed case in exchange for waiver of costs after defendant prevailed on a summary judgment motion that dismissed the heart of the lawsuit.
  • Represented national research agency in state gender discrimination lawsuit brought by a former employee. Case settled on terms defendant agency found extremely favorable.
  • Represented national health insurance company in a state lawsuit alleging age discrimination, retaliation, wrongful termination and breach of contract. Prevailed in summary judgment on all claims except breach of contract, and case thereafter settled for nominal amount.
  • Guided national and local companies through dozens of layoffs, including layoffs of over 500 employees, with particular emphasis on the federal and state WARN Acts, the intricacies of the selection process, proper documentation and managements' role in the overall process.
  • Counseled and represented multiple boards of directors regarding employment law compliance, fiduciary duties related to employment processes, handling and overseeing litigation, and corporate restructuring.
  • Represented a large San Diego nonprofit organization in arbitration on multiple claims, including claims for age and veteran status discrimination and contract violations. Prevailed on all counts after a four-day arbitration.
