Katherine Benesch practices in the areas of healthcare law and litigation, with particular emphasis on physician group practices, hospitals, hospital-physician relationships, academic medical centers, faculty practice plans, state and federal regulatory matters, fraud and abuse, managed care, faculty practice plans and employment and licensing matters. As a litigator, Ms. Benesch represents clients in trial and appellate cases involving physician, hospital and managed care liability, contract, credentialing, commercial, employment and reimbursement disputes and state licensure issues.
Ms. Benesch is a member of the American, Mercer County, New Jersey and Pennsylvania bar associations, the American Health Lawyers Association (vice chair of its Labor & Employment Law Practice Group), the Healthcare Financial Management Association and is a fellow of the American Bar Foundation. A frequent author and lecturer in the areas of health law and managed care, Ms. Benesch is a member of the Advisory Board of the BNA Health Law Reporter and is listed in Who's Who in American Law, Who's Who of Emerging Leaders in America and Who's Who in New Jersey.
Ms. Benesch is a past president of the Princeton Bar Association, past chair of the Health and Hospital Law Section of the New Jersey State Bar Association, past chair of the Princeton Regional Health Commission and past governor of the American Bar Association Forum Committee (now Section) on Health Law. Ms. Benesch serves as an arbitrator for the American Arbitration Association and American Health Lawyers Association, and is certified as a healthcare mediator by the American Health Lawyers Association. She has served as an adjunct assistant professor at the University of Pittsburgh School of Medicine and the Robert Wood Johnson Medical School, and is on the Technical Review Board of the Princeton Journal of Bioethics. She was named by Nightingale's Healthcare News as one of the Outstanding Hospital Attorneys for 2004.

Representative Matters
- Counsel in various litigation matters involving the rights of physicians to practice medicine as a member of a hospital staff. These cases have involved multiple claims against our clients, including antitrust, defamation tortious interference with business relationships, discrimination and infliction of emotional distress. Successful results have been achieved prior to trial in all cases.
- Mediation of a $25 million managed care reimbursement lawsuit, which was resolved through the renegotiation of a $400 million nationwide business agreement between the parties.
- Development and ongoing representation of two professional corporations for the full-time faculty of a major medical school.
- Counsel to a consortium of hospitals operating regional and statewide ambulance services to assist in the restructuring of its corporate entities.
- Counsel representing physicians and other healthcare professionals and organizations in administrative hearings before state licensing boards, with successful outcomes in almost all cases.
- Litigation Counsel to one of the premier national research laboratories in the country, including continuing resolution of disputes involving the Freedom of Information Act, the federal whistleblower and false claims statutes, as well as routine commercial litigation. To date, all cases in which firm counsel have defended this client have been dismissed.
- Representation of professional corporations and healthcare organizations in mergers and acquisitions, including development of operational and compensation documents.
- Representation of healthcare professionals and organizations in state and federal courts and administrative hearings before state boards and insurance commissions, with successful outcomes in almost all cases.
