Patrick J. Kearney practices in the area of construction litigation. Mr. Kearney has counseled clients, including owners, contractors (general, electrical, mechanical, plumbing, roofing, paving and others, both as prime contractors and as subcontractors), materialmen, suppliers, architects and engineers, on a wide variety of both private and public projects. He has handled matters involving surety law, mechanic's liens, claims for delay and inefficiency and all types of other contract disputes.

Mr. Kearney is a 2003 graduate of Rutgers School of Law-Camden and a cum laude graduate of Temple University.

Representative Matters

  • Filed, prosecuted, and/or defended over one hundred mechanics' lien claims in New Jersey and Pennsylvania.
  • Represented a national contractor in pursuing a claim in state court for changed conditions, labor inefficiency and extra work on a project involving the construction of a casino, with an outcome the client found favorable.
  • Participated in litigation on behalf of a developer defending claims brought by a contractor for unforeseen site conditions.
  • Represented a large mechanical contractor in a mediation of a delay and inefficiency claim on a project involving the construction of an NFL football stadium, with an outcome the client found favorable.
  • Obtained the dismissal of claims brought by an electrical contractor who was seeking to recover millions in delay costs, inefficiency and extra work.
  • Resolved to the client's satisfaction a multimillion-dollar suit in Connecticut federal court on behalf of a national electrical contractor on claims brought on a project involving the construction of a high-rise building in Hartford.
