Ryan A. Loosvelt is a partner in Duane Morris' Las Vegas office. Mr. Loosvelt practices in the areas of commercial and civil litigation with an emphasis on business litigation, and has successfully defended and prosecuted numerous actions through trial and arbitration for his business clientele.

Mr. Loosvelt's commercial litigation practice includes, but is not limited to: business torts and statutory violations (such as common-law fraud and consumer fraud, breach of fiduciary duty, interference with contractual and prospective economic relationships, misappropriation of trade secrets, deceptive trade practices, conspiracy, etc.); contract disputes (such as breach of commercial contracts, NDA agreements, non-competition provisions, employment agreements, etc.); white-collar civil defense (such as RICO, fiduciary duty, and fraud charges); construction law (including design issues, defects, mechanics liens, etc.); defamation law (including slander and libel for both public and private figures); products liability (based in negligence, negligence per se, and strict liability); equitable and extraordinary relief (including injunctive relief, unjust enrichment, etc.); insurance coverage law (including coverage analyses and opinions, equitable contribution amongst insurers, defense of bad faith and unfair claims handling claims, and policy reformation, etc.); and, significant experience with state and federal banking law as well as foreclosure litigation on behalf of national banking clientele. In addition, Mr. Loosvelt has both prosecuted and defended complex litigation matters involving business, construction, securities, and environmental issues.

Mr. Loosvelt also practices in the area of intellectual property litigation involving matters such as cybersquatting, trademark infringement, unfair competition and unfair trade practices, and has successfully obtained several judgments against cybersquatters and trademark infringers and diluters. Mr. Loosvelt additionally practices in the area of securities law, including violations of the Securities Act of 1933 and the Securities Exchange Act of 1934, and has successfully defended cases and obtained dismissals of clients alleged to have violated the United States securities laws. As a law student, Mr. Loosvelt assisted in the prosecution of several national securities class actions and shareholder derivative suits. Mr. Loosvelt is also experienced with bankruptcy matters, including adversary actions, proofs of claim, and non-dischargeability of debts, as well as appellate practice including experience with notices of appeals, docketing statements, appellate briefing, and appellate motion practice.

In addition to his litigation and appellate practice, Mr. Loosvelt further manages and oversees his clients' legal needs outside the litigation realm, providing his clients with a full-service relationship. He coordinates with the vast community of world-wide Duane Morris attorneys to provide his clients a broad range of services, including copyright, trademark and patent issues, internet privacy and security issues, corporate consulting, emerging business issues, franchising and licensing, and other business-related issues.

Mr. Loosvelt's clients include Fortune 500 companies and their affiliates, international casino resort hotels, national and local businesses, national banks, leading construction contractors, insurance companies, and public figures, as well as internet startup companies. He is also very active in pro bono work and has prosecuted Hague Convention proceedings involving international child abductions on behalf of indigent mothers whose children have been abducted across international borders.

Representative Matters

  • Represented international corporation located in England and doing business in India against disgruntled shareholder. Overturned injunctive relief and appointment of receiver within weeks of retention allowing client's approximate $30 million sale of interest in Indian airline to proceed unfettered.
  • Represented parent company to worldwide casino hotel resorts in business dispute involving international parties based in United States, China, France, and Israel. Obtained full judgment in favor of client on contract and tort claims on second day of trial.
  • Represented Fortune 500 corporation in litigation against two serial cybersquatters. In three-month span, obtained permanent injunctive relief, return of over 20 domain names, and approximately $1 million in statutory and corrective advertising damages, and attorney's fees and costs.
  • Brought in by national corporation weeks prior to appellate oral argument before the Nevada Supreme Court to replace trial counsel. Drafted and submitted comprehensive Supplemental Appellate Brief, directly resulting in appellee accepting settlement offer prior to oral argument for $2 million less than judgment obtained by jury verdict.
  • Represented Swiss-based asset managers, banks and their officers in international action alleging securities law violations relating to alleged non-disclosures and misrepresentations in connection with a tender offer. Obtained dismissal of all claims against clients shortly after filing comprehensive motion to dismiss the complaint.
  • Brought suit in Las Vegas on behalf of national furniture rental company in series of unfair competition, misappropriation of trade secrets and breach of employment agreement actions across the country against competitor that was stealing employees and raiding client's trade secrets. Obtained favorable resolution of case after filing motion for preliminary injunction contributing to global resolution of controversies between parties.
  • Represented ocean carrier headquartered in Shanghai, China against strict liability and negligence per se claims as a result of alleged injuries from the international transportation of hazardous chemicals. Obtained summary judgment on all claims in favor of client.
  • Represented national banking association in AAA arbitration against business customer seeking $1 million in damages for past and future lost profits. Successfully obtained defense judgment in favor of client and award recovering all attorney's fees and cost of arbitration.
  • Represented world-class hotel casino resort in contract-based construction suit regarding design of theatre for top Las Vegas show. Obtained resolution that client/owner found favorable on counterclaims against architect prior to binding arbitration.
  • Managed the intellectual property of an Internet startup business intelligence software company focusing on predictive analytics, including patent applications, consumer privacy issues, terms of use, and trademark matters. Company obtained multiple rounds of financing from prestigious east coast venture capital firm.
