He has represented interests relating to the construction and project finance processes, including owners, developers, lenders, institutions, program managers, construction managers, general contractors, architects, engineers and trade contractors. His experience includes international and domestic contract negotiation and documentation; construction management, general contractor and design-build agreements; general conditions integrated and coordinated with those of the architect/engineering team; trade contracts; agreements with the design team; development agreements; and design, build, operate and turn-over agreements. 

Some recent examples of projects in which Mr. Silverman has represented owners include the World Trade Center Memorial, the JetBlue Terminal at JFK Airport, high-tech uplink facilities for Home Box Office and the new campus for the Hunter College School of Social Work of the City University of New York.

Mr. Silverman is also experienced in distressed property workouts involving partially completed projects. He has written and lectured on construction industry problems involving creditors' rights and competing security interests and works closely with creditors' rights and bankruptcy lawyers in the Business Reorganization Department of Duane Morris.  

Complementing the transactional side of Mr. Silverman's practice are many years of experience in construction litigation and arbitration involving prosecution and defense of claims for extra work, delays, inefficiencies, and defective work.  Examples of defective work cases handled by him:  leaking building envelopes (e.g., fa&ccedil;ade, windows, roofs); mold; improperly performing heating, ventilating and air conditioning systems; geotechnical and building support problems; and structural deficiencies.

Mr. Silverman has had considerable non-lawyer, leadership experience on behalf of non-profit owners engaged in complex and successfully completed construction projects.  He also served for over 15 years as general outside counsel and board member of one of America's leading construction companies.  The experience gained from these real-world efforts inform Mr. Silverman's legal advice to owner/developer clients concerning preconstruction services, project development, risk allocation, scope, incentives, liquidated damages, contingencies, principal guaranties, surety bonding, subcontractor default insurance, timely performance, budget development and compliance, and cost control.

Prior to entering private practice, Mr. Silverman served a clerkship with the U.S. Court of Appeals for the Second Circuit. He is also an M.I.T.-graduate engineer.
