William J. Votta practices in the area of litigation. Mr. Votta's experience includes complex commercial litigation, employment litigation, business tort and contract disputes, shareholder and civil RICO disputes, and professional ethics and malpractice.
A member of the New Jersey State and Middlesex County bar associations, Mr. Votta is a 2002 graduate of Seton Hall University School of Law, where he was a member of the Seton Hall Law Review, and a graduate of Moravian College.
Representative Matters
- Second chaired trial for defense of high net worth individual's estate on claims arising from alleged breach of personal services contract between deceased client and co-entrepreneur. Drafted successful motion for partial summary judgment that decreased client's maximum liability from $5.5 million to $190,000.
- Obtained dismissal of claims against real estate developer client in federal suit brought by second developer alleging that client and other defendants conspired to usurp redevelopment rights properly belonging to second developer.
- Defended Kansas titling corporation named in consumer fraud class action suit over allegedly improper resale of cars repossessed from New Jersey residents. Succeeded in negotiating settlement of all claims against client for nuisance value.
- Obtained temporary restraining order preventing director of three close corporations from excluding second director from participating in the sale of the corporations or receiving sale information from the broker.
- Obtained summary judgment for airplane manufacturer in personal injury suit that allegedly occurred at airport construction site.
- Negotiated settlements in a number of suits arising from alleged breaches of commercial leases.
- Synovus Bank of Tampa Bay v. Valley National Bank, 487 F. Supp. 2d 360 (S.D.N.Y. 2007) - Bank client awarded summary judgment on $10 million claim asserted by credit card merchant bank based on alleged breach of federal financial regulations regarding charter airlines and various state law causes of action.
- Enron (Thrace) Exploration & Production, et al. v. Clapp, et al., 874 A.2d 561 (N.J. App. Div. 2005) - New Jersey Appellate Division upheld the right of client to domesticate money judgment obtained in England by filing judgment with Judgment Clerk rather than by instituting suit to domesticate.
