Duane Morris Partner Jason Pickholz to Be Panelist at ABA Teleconference and Live Audio Webcast on Honest Services Fraud

Duane Morris partner Jason R. Pickholz will be a panelist at a teleconference and live audio webcast sponsored by the American Bar Association Section of Business Law and Center for Continuing Legal Education. This program, "The Uncertainty Surrounding Honest Services Fraud," will be held on Wednesday, February 11, 2009.
Program Description
You have a client expecting litigation in a breach of contract case. Instead of receiving a summons and complaint, the client is arrested for mail and wire fraud for breaching the honest services owed under the contract. Honest services fraud is being prosecuted, in the private sector, based upon lack of integrity in typical business relationships engaged in on a daily basis.
This teleconference and live audio webcast will examine whether honest services fraud does and should extend this far.
- Can honest services fraud arise out of a breach of contract or, a violation of a workplace rule or regulation?
- If honest services fraud requires a breach of duty, must the source of the duty breached arise under federal or state law?
- Must the defendant foresee actual harm or intent to cause actual harm to violate the honest services mail fraud statute?
- Must the defendant intend to achieve a private gain?
- Can materiality substitute for foreseeable harm, intent to cause harm, and intent to achieve private gain?
