Duane Morris partner Rick Seabolt will be moderating a Law Seminars International teleconference on the topic of "Practice Under California's New Electronic Discovery Act," to be held on September 17, 2009, at 12 p.m. (Pacific time). Mr. Seabolt will provide an introduction and overview of the topic from a trial lawyer's perspective and moderate a panel discussion featuring distinguished attorneys.
About the Program
On June 29, 2009, the California Electronic Discovery Act became law as emergency legislation effective immediately in all California state courts. This program will address the expected impact of the resulting new discovery rules—and even newer August 2009 Rules of Court. Topics will include the scope of discovery, the treatment of "not reasonably accessible information," inadvertently produced privileged information, and the effect of the safe harbor provisions. The panel also will discuss key practical aspects of electronic discovery, including the effectiveness of a "clawback" provision, the use and effect of "litigation holds," the use of keyword search terms, new search software tools and the broader impact of e-discovery on litigation. This program is geared toward trial attorneys, in-house counsel, corporate executives and governmental officials responsible for managing litigation involving electronic documents, as well as judges and trial consultants.
