Duane Morris partner Katherine Benesch will be speaking at the New Jersey Hospital Association's (NJHA) meeting of the committee of hospital general counsel, to be held on December 8, 2009, in Princeton, New Jersey. Ms. Benesch will speak on the topic of "The New Frontier in Hospital Liability: Board Accountability for the Medical Staff."
About the Program
While hospital boards of directors have always had oversight responsibility for the institution, the responsibility for the medical staff has usually been delegated to the medical staff organization and its component committees. Both state and federal authorities are placing new emphasis on the board's responsibility for quality of care. Increasingly, the failure of the board and hospital administration adequately to oversee quality of care is creating liability for fraud and breach of fiduciary duties. The term, "Quality Fraud" has crept into the vocabulary. This program will examine these issues and discuss how the government is applying the False Claims Act to prosecute hospitals and their executives.
