Duane Morris partner Robert M. Fineman will be a panelist at the Strafford Publications teleconference, "Additional Insured Coverage: Reconciling Business Contract Obligations and Policy Terms," to be held on Tuesday, March 23, 2010, from 1 p.m. to 2:30 p.m. (Eastern time).
This 90-minute CLE seminar will discuss various forms of additional insured coverage and will analyze the interrelationship between contract requirements for additional insured coverage and actual insurance coverage. The panel will outline ways to maximize coverage and resolve coverage disputes.
Additional insured coverage is commonly used by parties in business relationships to spread and transfer risk. The party seeking to be named as additional insured needs to ensure that it has the broadest form of coverage available.
Naming another party an additional insured under a liability policy is often done in connection with indemnity agreements. However, confusion arises over the interplay between contractual indemnification provisions, insurance policy requirements, and additional insured status.
Situations where a party is covered by its own insurance and is an additional insured under another party's insurance trigger more difficult questions. Resolving which policy provides primary coverage and which is excess is often contentious.
