Duane Morris partner Seth v.d.H. Cooley will be moderating a panel at the Pennsylvania Environmental Council and Duquesne University Marcellus Shale Policy Conference, to be held on May 3-4, 2010, in Pittsburgh, Pennsylvania. Mr. Cooley will serve as moderator during a discussion on the topic "Post Development and Long-Term Responsibility" on Tuesday, May 4, from 11:00 a.m. to 12:30 p.m.
The scope of this session encompasses topics that are associated with the production phase of the Marcellus well life cycle and the post-production decommissioning and reclamation phase. Among the well development topics that may be covered are:
- Air emissions
- Noise
- Infrastructure operation and maintenance (e.g. impoundments, gathering lines, compressor stations)
- Long term maintenance of sedimentation and erosion controls
- Management of liquids (e.g. produced water and storm water) and spill prevention and control
- Best management practices for routine monitoring and inspections of infrastructure
- Best management practices for monitoring of potential environmental issues (e.g. gas migration from the well, impoundment leaks, other sources of unintended discharges to groundwater or surface water)
- Long term impacts (positive and negative) on the local community and neighboring land owners
- Assurance that decommissioning and reclamation will be performed properly (including the concept of utilizing a trust structure adapted from the DEP's surface mining alternative financial assurance program rather than a bond structure to provide financial assurance)
About the Pennsylvania Environmental Council and Duquesne University Marcellus Shale Policy Conference
The objective of the Marcellus Shale Policy Conference is to convene well-informed members of oil & gas industry, environmental organizations, state and local government, science community, and other interested stakeholders, to engage in active discussion on the currently unresolved challenges imbedded in the development of the Marcellus Shale formation. The Conference will not be just a series of presentations - it will be an open interactive dialog.
The Conference will examine many issues in depth, including:
- What are the most important unresolved regulatory issues concerning development; including frack water management, siting criteria, post-development operations, and long term responsibility?
- What are the lessons learned from past resource development that Pennsylvania should observe with existing and future development?
- What have other states done that may prove useful for Pennsylvania? Are there applicable regulatory or development best management practices which can be adopted in Pennsylvania?
- In the end, what should a comprehensive regulatory program look like in Pennsylvania? What are the pros and cons of that program?
