About the Program
The Centers for Medicare and Medicaid Services (CMS) has emphasized the scrutiny which it and other agencies will use while focusing on the business arrangements between nursing facilities and long-term-care pharmacies. In late 2009, several national providers of pharmacy services paid millions to resolve allegations of kickback schemes, including allegedly providing consultant pharmacist services at rates below fair-market value, to induce nursing facilities to refer their residents' business to them.
We will discuss the federal government's interpretation of "fair-market value" as it pertains to pharmacy and pharmacist consulting agreements with nursing facilities and the impact of healthcare reform. We will also review recent and upcoming changes to the Medicare Part D prescription drug benefit, which will affect many residents residing in long-term-care facilities.
Speakers
Nicholas J. Lynn is vice chair of Duane Morris' Health Law Practice Group. He focuses his practice on pharmaceutical law, healthcare litigation and regulatory compliance matters. A registered pharmacist with more than 25 years' experience in healthcare law, he is a former division chief and assistant chief counsel to the Illinois Department of Public Health. Mr. Lynn is a member of and general counsel to the Illinois Health Care Association, and past president of the American Society for Pharmacy Law.
Mary Lou Gradisek is vice president of customer service at Omnicare, a Fortune 500 company that serves as a network of pharmacies to skilled nursing, assisted living and other healthcare facilities in the United States and Canada. Ms. Gradisek also chairs Omnicare’s Medicare Part D leadership task force and works with CMS on major issues. She represents Omnicare with the Long Term Care Pharmacy Alliance (LTCPA) and the CMS Long Term Care Group.
