Duane Morris partners Nicholas J. Lynn and Jon Zimring will be speaking at the Illinois Nursing Home Administrator's Association (INHAA) Summer Conference, to be held on August 11-12, 2010, in Bloomington, Illinois. Mr. Lynn will discuss the "Nursing Home Care Act," and Mr. Zimring will speak on "Hot Topics in Employment Law." Their presentation will take place on Wednesday, August 11, from 2:30 p.m. to 4:30 p.m.
About the Presentation
Although Governor Quinn's nursing home task force was convened to discuss problems related to only those facilities which care for the mentally ill, it was expanded to address all of the purported ills in the long-term care industry, ultimately resulting in Senate Bill 326, which is the most sweeping reform to the NHCA in 25 years.
This presentation will review the acrimonious debates between the long-term care industry and its opposition, compare the SB 326 revisions to the NHCA and discuss, in detail, the substantial changes to the NHCA such as a new definition of "identified offender," a new definition of "neglect," new Type "AA" violations and related sanctions, new definitions of Type "B" and "C" violations and related sanctions, a new definition of "serious mental illness," new screening and pre-screening requirements prior to a resident's admission to a facility, the new expanded criminal history back ground check pilot program, new staffing ratios effective July 1, 2010, the new comprehensive resident care plan, and new whistleblower protections among, other changes.
There will also be a discussion of Illinois legislative efforts which have taken Illinois to the cutting edge of employee rights in the workplace. The Illinois Supreme Court has recently been following suit. With the myriad of state and federal employment law developments, employers now face special challenges, particularly where employee rights seem in tension with resident rights and regulatory requirements. This session will address both employment law changes and how to navigate these changes.
