Duane Morris attorney Michael E. Clark will be a panelist for a Compliance Committee CLE program at the ABA Annual Meeting, "Confronting Thorny Issues in Internal Investigations." The program will be held on August 7, 2010, at the Fairmont Hotel in San Francisco.
The panel will address topics that include: Best Practices in Internal Investigations, such as: the selection of the appropriate format for providing results of an internal investigation; what ethical issues arise from a potential conflict between business leaders within the company and who decides who the client is and who is responsible for internally managing the investigation?; is the investigation proactive or reactive: should it only address issues that have been previously reported or should it address ongoing, systemic misconduct not specifically reported? Discussion of how the different agencies are imposing more stringent notification requirements in certain areas.
