Duane Morris partner Mark A. Fischer will be speaking at the Boston Bar Association program, "Recent Trends in Copyright and Trademark Fair Use—How Fair Is Fair Enough?" on Wednesday, September 8, 2010, in Boston, Massachusetts. Mr. Fischer will present on the topic of "Don't Ask, Don't Pay: Recent Fair Use Cases and Developments."
Are practical fair use determinations becoming more predictable? Is transformative use less important and is the 4th factor more? May we call this affirmative defense a right? A look at recent developments, including the impact of the James Joyce letters case, Harry Potter, J.D. Salinger, Turnitin, and numerous Google cases. No doubt there will be even newer cases by September in this fast-moving, ever-evolving field.
About the Program
Fair use is a commonly asserted defense, yet it is elusive and difficult to define. The cases are fascinating, but are they consistent? What is the social function of fair use, and is it working? This seminar examines fair use and recent trends in how it is being litigated and adjudicated. Attendees will gain a better understanding of fair use in both copyright and trademark law. This program will help intellectual property and entertainment attorneys better understand and advise their clients on the risks when using another's work, or another's brand.
The program will be held from 2 p.m. to 5 p.m., and a reception will follow.
