HFMA Florida Chapter Teleconference: Retroactive Application of AHCA's Undocumented Aliens Policy

Florida's Agency for Health Care Administration (AHCA) has changed its policy regarding payment for emergency services rendered to undocumented aliens, effective July 1, 2010. In addition, AHCA has also implemented a retroactive review of claims for emergency services rendered on or after July 1, 2005. Moreover, this retroactive review is being maintained through AHCA's Medicaid Integrity Program; a peculiar choice in light of the fact that the vast majority of the claims paid for undocumented aliens were approved by KePRO prior to payment.
There are serious questions as to the appropriateness of AHCA's new policy going forward, as well as a basis for retroactively recouping payments already made. Regardless of whether you have already received demand letters from AHCA's Medicaid Program Integrity division or not, this issue impacts your facility as long as you will or have billed Medicaid for services provided to undocumented aliens.
