Duane Morris partner Stanley A. Martin will be speaking at the Boston Bar Association's "Negotiating and Drafting Construction Contracts" CLE seminar, to be held on Wednesday, March 30, 2011, from 2:30 p.m. to 5 p.m. in Boston, Massachusetts. The program will also be available as a webcast via WestLegalEd Center.
About the Seminar
Current trends and forecasts point toward a thaw in the commercial construction market. If true, construction lawyers will need to refocus on the transactional aspects of their practices and revisit the contract forms and negotiation skills which they have not utilized as frequently over the past few years. In addition, the recent changes to the Mechanics Lien Act providing lien rights to design professionals and the introduction of the prompt pay law will impact the contracts governing construction projects.
This program will provide information and strategies in negotiating and drafting the most commonly used construction contract forms. Our panel will review drafting techniques, with special attention paid to contract provisions addressing the recent changes to the Mechanics Lien Act and the Prompt Pay Act. Next, the panelists will engage in mock negotiations regarding common provisions on behalf of owners, general contractors and subcontractors. Topics will include: arbitration v. litigation, payment/performance bond requirements and liquidated damages. Finally, the panel will explain the differences between the ConsensusDocs form and the traditional AIA documents.
