Duane Morris Institute presents a Wage and Hour Day, to be held on Tuesday, March 22, 2011, from 9 a.m. to 3 p.m. at Duane Morris' Philadelphia office. The seminar, presented by Duane Morris partners Jonathan A. Segal and Linda B. Hollinshead, will include sessions addressing issues involving both non-exempt and exempt employees. Attend both sessions and receive 4.0 Hours of PA CLE credits; 5.0 Hours of NJ CLE credits; and 5.0 Hours of NY CLE credits. 4.5 Hours of HRCI credit is pending.

This seminar will focus on some of the most commonly litigated FLSA and state wage and hour claims involving non-exempt employees that have resulted in eight-digit settlements and judgments. Issues to be addressed include: the interplay between federal and state law; alternative ways of calculating overtime; whether and when commissions, bonuses and other compensations must be included in calculating the regular rate for overtime purposes; compensation for preliminary and postliminary activities; compensation for work from home; compensation for training time, travel time and break time; automatic deductions for meal breaks; rounding up and down for lateness and overtime; how working off the clock happens and how to prevent it; when interns must be paid; and correcting time keeping and other errors. This 2½-hour seminar is designed for human resource professionals and in-house counsel.

This seminar will focus on when it is proper to classify employees as exempt. We will discuss the FLSA’s salary basis requirement, its minimum salary requirement and the duties requirements for exempt status. We will also discuss how state law can complicate the classification of employees as exempt. Employees get the benefit of whichever law is more protective which can be deceptively complex. Although often with the best of intentions, employers frequently do things that can jeopardize the exempt status of their employees. We will discuss what kinds of things can have this impact and how best to minimize the legal risk. This 2-1/2-hour seminar is designed for in-house counsel, human resource professionals and senior managers.
