Accountable Care Organizations: Legal and Operational Implications for Pennsylvania Hospitals

Mitchell Goldman will speak at the Hospital and Healthsystem Association of Pennsylvania seminar, "Accountable Care Organizations: Legal and Operational Implications for Pennsylvania Hospitals," to be held in two sessions: the first on Friday, May 6, 2011, at the Hilton Garden Inn in Fort Washington, Pennsylvania, and the second on Thursday, May 19, 2011, at the Hospital Council of Western Pennsylvania's offices in Warrendale, Pennsylvania. The faculty also includes John Harris, principal of DGA partners, a leading speaker on ACO strategy development.

About the Seminar

Accountable care organizations (ACO) present opportunities and challenges that every hospital leader must evaluate. Even hospitals that are not likely to pursue an ACO strategy now must evaluate how competitors may use ACOs to compete. This latest model for delivering services offers doctors and hospitals financial incentives to provide good quality care while keeping down costs. While designed to improve the coordination, quality, and efficiency of health care services, ACOs implicate existing fraud, abuse, and Medicare laws. The Centers for Medicare & Medicaid Services recently released its proposed rule to implement the Medicare Shared Savings Program, also known as ACOs. Due to the complicated nature of ACO development, CMS worked with several other federal agencies including the Office of Inspector General, the Department of Justice, the Federal Trade Commission, and the Internal Revenue Service in promulgating the regulations that will govern ACOs. Understanding these regulations will be critical to understanding a new competitive landscape for hospitals.

Don't miss this important education session designed to help Pennsylvania hospitals better understand the legal implications and operational challenges of ACOs. Program faculty will provide a balanced viewpoint by discussing practical questions concerning the funding, formation, and operation of ACOs—including potential legal and operational infrastructure, clinical integration, and governance of ACOs. The program is designed to address key legal, strategic, financial, and operational considerations to help hospitals decide whether or not to execute an ACO.

  • Explanation of the latest Medicare rules and regulations and implications for Pennsylvania hospitals.
  • Sequencing and alignment of critical operational and organizational capabilities necessary for sustainable transition to accountable care.
  • New legal developments regarding ACOs, especially with respect to antitrust, Stark, and antikickback changes to accommodate ACOs.
  • Financial considerations for whether to develop an ACO, including the benefits and burdens of participation.
  • Provision of an understanding of the new definition of clinical integration.
  • Avoiding three key mistakes in deciding to create an ACO.
  • How to decide whether an ACO strategy makes sense for your hospital/health system.
