Duane Morris partner Sheila Hollis will be speaking on the subject of "Shale Gas Development: An Update on Federal Law and Policy Developments" for a Practising Law Institute (PLI) webcast on Tuesday, November 8, 2011 at 1:00 pm Eastern time.
The shale gas revolution is well under way and is quickly becoming the foundation of our national energy policy supply assumptions. As concerns have arisen over the availability of electric generation fueled by coal; some renewable sources; nuclear energy as a result of natural disasters; inadequate responses; market conditions; and greenhouse gas emission concerns, we as a nation are turning quickly to the seemingly available and reasonably-priced natural gas supply, most of it produced from shale gas through the hydraulic fracturing process. Like all easy answers to big and complex needs, there are pros and cons to its development. Yet, the development of these supplies is moving at breakneck speeds throughout the country.
This massive effort is creating a regulatory and policy "swarm" at the state and federal levels. The briefing focuses on the federal developments impacting the shale gas development. There are existing regulations and policies, and on the horizon, a massive series of initiatives of which producers, pipelines, utilities, regulators and their attorneys must be aware.
This program will set out the major efforts of the Departments of Interior, Energy, Agriculture, EPA and FERC regarding policy and regulations. Many other players on the scene are making their voices heard as well, including the SEC. In addition, speakers will address the following developments:
- The Secretary of Energy Advisory Board (SEAB), DOI and EPA are working aggressively to develop a framework for the next steps in making the development of the shale gas via fracking a viable, safe and responsible industry.
- The EPA continues its efforts to monitor and enforce air and water quality and safety in the industry.
- The DOI is moving forward with enlightened policies attuned to the state’s experience and guidelines.
- Infrastructure development, such as pipelines and other structures, is being authorized by FERC in a comprehensive analytical framework.
- Disclosure of chemicals is being sought by the EPA, DOI and the SEC
