Duane Morris partners Richard Lowe, Albert Bates, Jr. and Damon Fisk will be speaking at two different sessions during the Construction SuperConference 2011. Mr. Lowe will moderate a panel including Mr. Fisk on the topic of "A Comparison of Location-Based Construction Scheduling Method with the Traditional Critical Path Method: New and Improved, or More of the Same?" on Thursday, December 15, 2011. Mr. Bates will be a panelist discussing "Building the Construction Arbitration Process to Optimize Its Advantages" on Friday, December 16, 2011.
The panel led by Mr. Lowe will explore how the constraints and logic that a Location-Based Management System (LBMS) uses for construction scheduling, planning, and control are similar to or different than the traditional Critical Path Method (CPM). Panelists will explore LBMS's focus on resources and productivity—rather than time; flowline charts—rather than CPM bar charts; and buffers—rather than float. Also, the panel will discuss contractual issues, and explain how LBMS is currently being used on large projects in the Bay Area.
Mr. Bates will explore arbitration as a means of resolving construction disputes. Parties must be active participants in making it an effective process. This interactive panel discussion will explore the ways parties should build the arbitration process—from the agreement drafting phase through the final award—to reap the benefits arbitration was intended to provide. The following critical action points will be discussed: arbitrator selection; preliminary management hearings and orders; controlled information exchange; better use of expert witnesses; efficient hearings; and the award. Experts on the panel will discuss as to what they do to make their cases work.
