Duane Morris Partner Jonathan Armstrong to Speak at Anti-Corruption and Bribery Compliance Conference

Jonathan ArmstrongDuane Morris Partner Jonathan Armstrong, of the firm's London office, will be participating in two panels at the The Canadian Institute’s Anti-Corruption and Bribery Compliance Conference on Monday, January 30, 2012 and Tuesday, January 31, 2012 in Toronto, Ontario. He will be discussing "US, UK, EU, Canada: How Does it All Fit Together?" on Monday, and "What to Do When Your Organization is the Subject of an Investigation" on Tuesday.

In recent months, serious enforcement of anti-bribery and corruption legislation has begun, with examples such as the $9.5 million penalty imposed on Niko Resources and a high-profile raid on SNC Lavalin bringing the issues to the spotlight. The Canadian Institute's Anti-Corruption and Bribery Compliance Conference will provide attendees with the tools and strategies needed to remain compliant in the face of the new and complex regulations.

"US, UK, EU, Canada: How Does it All Fit Together?" aims to address the extent to which Canadian multination corporations are subject to the American Foreign Corrupt Practices Act (FCPA) and the UK's new Bribery Act. This extensive panel will examine the similarities and differences between the pieces of legislation, from key features to application to the types of penalties available. In addition, panelists will delve into other regulations Canadian companies should be aware of; issues of jurisdiction; how government agencies are working together to regulate international corrupt practices; and what industries are being targeted for enforcement.

On day two, Mr. Armstrong will explore "What to Do When Your Organization is the Subject of an Investigation." This panel will take a closer look at how to respond to investigation, from the role of the Board of Directors to negotiating immunity. Other topics include:

  • Communicating effectively with enforcement agencies
  • Litigation holds
  • Considerations for publicly traded companies
  • Managing document preservation, collection and review
  • Preserving privilege in countries where it is recognized
  • Managing legal and compliance costs
  • Cooperating with investigators while protecting your organization from potential follow-on lawsuits
  • What federal law enforcement agents look for when meeting with defense attorneys
