Duane Morris partner Beatrice O'Donnell will be serving as moderator for the panel discussion on "When Can a Breach
of Contract be a Tort and What Difference Does It Make?" at the ABA Section of Litigation, Committee on Corporate Counsel CLE Seminar on Saturday, February 18, 2012.
The judicially created doctrine known as the Economic Loss Rule has developed over the years from a little quirk in the law of products liability to a total bar against claims for business losses for which contracting parties did not expressly allocate the risk. In recent cases, courts have recognized the Frankenstein monster created by some earlier holdings and have started to retrench. This program will analyze the reasons for the rule and the merits of interpreting it narrowly or broadly.
