Duane Morris special counsel Michael Clark will be part of a panel discussion on "Parlez-Vous Kickback? The Application of the Foreign Corrupt Practices Act to the Healthcare Arena," on Thursday, February 23, 2012 at the ABA Section of Health Law's Emerging Issues in Healthcare Law Conference 2012.
The ABA Health Law Section's Conference on Emerging Issues in Healthcare Law covers the most emergent topics facing the healthcare bar. As the industry undergoes changes and continues to develop with healthcare reform, this conference presents an opportunity to stay ahead of the trends. The conference features 16+ hours of CLE programming, including five plenary sessions, twelve concurrent Interest Group CLE programs, and an ethics session. This year's conference will also offer pre-conference sessions—a Breast Cancer Legal Advocacy workshop, fundamentals of healthcare law for those new to the area or in need a review, and a conflict resolution workshop geared toward healthcare providers. With globalization, more pharmaceutical, medical device manufacturers, and providers are operating outside the United States where government involvement in healthcare is pervasive. Given regulators' expansive interpretations of "foreign official," many companies risk running afoul of the Foreign Corrupt Practices Act (FCPA). This interactive panel will provide an overview of FCPA, its potential penalties, which can include debarment or exclusion, and the advisory opinion process. Panelists will also discuss recent healthcare related enforcement trends; developing appropriate compliance programs; practical tips for recognizing red flags of potential violations; and ways of responding to potential violations.
