Duane Morris Partners Albert Bates, Jr. and Richard Lowe to Speak at the 2012 American Arbitration Association Construction Conference
June 1, 2012 | New York City
| New York University
Duane Morris partner Richard Lowe will be discussing "A Creature of Contract: Drafting Construction ADR Clauses to Meet Project Needs," at the 2012 American Arbitration Association University (AAAU) Construction Conference on Friday, June 1, 2012. Partner Albert Bates, Jr. will be part of a panel discussion on "Optimizing Your Client's Construction Arbitration Hearing," also on Friday, June 1, 2012.
Disputes can happen at any stage of a project. The best protection that savvy attorneys, architects, owners, developers, contractors, engineers and other construction professionals can have is to be aware of arbitration strategies that can quickly and cost-effectively resolve disputes. Noted construction industry experts come together to deliver tips and techniques to help attendees reduce the time and cost involved in arbitration without compromising quality or effectiveness. The program includes a Corporate Counsel Roundtable, where chief legal officers, using real-world scenarios, will discuss corporate strategies for an effective arbitration.
The morning session on "A Creature of Contract: Drafting Construction ADR Clauses to Meet Project Needs" will explore what to include, and how to draft, ADR clauses to best suit the needs of the projects. Panelists will discuss the construction industry standard for form ADR contract clauses; elements of individually tailored or negotiated clauses; and practical considerations when drafting ADR clauses.
"Optimizing Your Client's Construction Arbitration Hearing" focuses on the ways to get the most out of arbitration, including how to approach the arbitration. Panelists will examine each of the following considerations essential to successfully navigating the world of construction arbitration:
- Begin with the End in Mind
- Consider the Human Elements
- Keys to Maintaining an Efficient Schedule
- Evidence: Everything May be Permissible, But Not Everything is Profitable
