Duane Morris Attorneys Ralph Smith 3rd and Natalie Hrubos to Speak at the Fundamentals of Employment Law Seminar

Duane Morris attorneys Ralph Smith 3rd and Natalie Hrubos will be speakers at the Fundamentals of Employment Law Seminar hosted by Sterling Education Services on Tuesday, June 26, 2012, in Claymont, Del.

When a problem arises and there isn't time to research the law, decisions still must be made. It is essential to understand the fundamentals from which new developments are emerging. This seminar addresses the issues, including health care reform, most likely requiring such decisions. A group of accomplished and highly knowledgeable speakers will help provide workable solutions to common employment law problems.

Ms. Hrubos will be discussing "Sexual, Racial, and Other Harassment in the Workplace," a hot topic that most employers are bound to face at some point. This session will provide an extensive look at harassment issues in the workplace, as well as some possible ways for employers to address these tough topics. Discussion includes answering questions such as "what constitutes a hostile workplace environment?" and how to differentiate between harassment, discrimination, and obnoxious behavior. She will also provide an overview of relevant legislation and recent court cases; employer liability principles as they affect management of complaints; liability for claims of harassment by third parties; and how to conduct a lawful misconduct investigation. Finally, Ms. Hrubos will cover the "4 P's for Avoiding Harassment Claims": policy, protection, prompt, and punishment.

In two separate sessions, Mr. Smith will explore "Privacy and Social Media in the Workplace" and "ADA and FMLA Updates and Interplay." More and more, employers are having to figure out how and when to use social media in the workplace, with no easy answers. This session delves into the issues employers face, including: balancing an employer's right to know against employee privacy rights; using social networking sites for employment purposes, both the risks and some best practices; off the job behavior; privacy issues in formal complaint procedures; information disclosure; and case law studies relating to social media. "ADA and FMLA Updates and Interplay" examines some of the most recent changes made to the FMLA, ADA and EEOC guidelines. This session will look at the expansion of what is considered a disability, what EEOC considers accommodation, and a shift in prohibited action cases. He will also discuss how the new ADAAA rules impact HR, the effect on FMLA and other leave policies, and the interplay between the ADA and the FMLA.
