Duane Morris partner Paul Rosenlund will be part of a panel discussion on "Product Liability Recalls: Preparing for a Recall and Mitigating Legal Risks" at a Strafford webinar on Wednesday, June 20, 2012 from 10:00 a.m. to 11:30 a.m. (Pacific time).
How counsel assesses, prepares for and mitigates risks in a product recall differs depending on whether the recall is voluntary or government mandated. Failing to conduct a recall in a reasonable manner or to issue a recall when appropriate can expose your client or company to liability. With state law divided on recall obligations and potential federal law preemption in the area of recalls and product liability, counsel must assess which laws will apply and the potential liability and damages exposure. A panel of product liability attorneys will discuss approaches for preparing for, assessing, managing and mitigating risks associated with a product recall. The panel will identify defense strategies when a recall is issued, whether voluntary or government mandated. Speakers will review key questions such as:
- How do counsel's approaches differ for government-mandated recalls vs. voluntary recalls?
- What are the timing issues that must be considered in issuing a recall?
- What are the key defense strategies in a suit resulting from a product recall?
