Duane Morris Partner Vincent Capuano to Moderate Panel on "Third Party IP: Preserving Freedom to Operate"

Vincent CapuanoDuane Morris partner Vincent Capuano will be acting as moderator for a panel discussion on "Third Party IP: Preserving Freedom to Operate" at The Food and Drug Law Institute's (FDLI) conference on IP Throughout the Drug Development Lifecycle on Tuesday, July 17, 2012, in Washington, D.C.

Speakers will address the intellectual property issues most important to patent litigators and in-house counsel in the pharmaceutical industry as well as the critical regulatory issues affecting the pharmaceutical industry. This focused conference addresses relevant IP topics, including patent, trademark and copyright issues throughout the drug development lifecycle—from pre-clinical development to post-marketing protection and enforcement. The subject is timely for professionals working with both brand and generic pharmaceutical companies. The implementation, maintenance, and defense of the exclusivity of these IP rights is one of the most significant legal and business issues in this era of evolving patent standards.

"Third Party IP: Preserving Freedom to Operate" will focus on the rights required to ensure freedom to operate for third parties. Participants will address subjects such as:

  • Surveying the landscape;
  • Obtaining competent clearance opinions;
  • Overcoming or working around blocking patents;
  • Taking advantage of the 271(e) (1) "safe harbor"; and
  • Off-shoring strategies and issues.
