Duane Morris partners David Loder and Lisa Clark will be discussing "Act 55 Update: Meeting Tax-Exempt Responsibilities in Pennsylvania" for a Hospital & Healthsystem Association of Pennsylvania (HAP) audioconference on Wednesday, July 18, 2012.
On April 25, 2012, the Pennsylvania Supreme Court issued a decision in a case (Mesivtah Eitz Chaim of Bobov, Inc. v. Pike County Board of Assessment Appeals) that has a significant impact on how not-for-profit entities, including hospitals, will qualify for property tax exemption under state law. This decision may lead to a renewed interest by political subdivisions in challenging the tax-exempt status of properties owned by not-for-profit organizations for purposes of securing real estate taxes, payments in lieu of taxes (PILOT), and/or services in lieu of taxes (SILOT).
This audioconference will assist not-for-profit hospitals in understanding the potential implications of the recent Pennsylvania Supreme Court decision, potential risks for not-for-profit hospitals to consider under the "HUP test," and issues for consideration in exploring PILOTs, SILOTs, or other arrangements with political subdivisions, etc. Speakers will provide tips on how to take steps to strengthen your position to meet tax-exempt status requirements in Pennsylvania.
