Duane Morris Patent Agent Dr. Johann Lin to Speak on Patent Eligibility of Diagnostic/Personalized Medicine Methods

About the Program

How can Diagnostic, Personalized Medicine and Biotechnology companies protect their inventions?

In Prometheus, the U.S. Supreme Court addressed the patent-eligibility of diagnostic/personalized medicine methods that were characterized as being based on a law of nature. While the court invalidated the patent claims at issue, questions remained as to how this holding will be applied to other cases, and whether it may still be possible to patent methods in the diagnostic/personalized medicine sector.

In Myriad, the Federal Circuit addressed the patent-eligibility of DNA isolated from nature that is associated with a particularly aggressive form of breast cancer. While the Federal Circuit upheld the claims, it is not clear whether it—or the U.S. Supreme Court—will uphold them again in view of Prometheus. If not, will diagnostic and biotechnology companies have other ways of protecting their inventions?
