One year after the Act came into force, the U.K. Bribery Act 2010 is still being called "the toughest enforcement standard in the world." It is important to remember that the law applies to the way we do business at home and abroad and no one is immune. The Act includes jail terms of up to 10 years. It also includes for the first time a new offence of failure to prevent bribery—effectively shifting the burden of proof on a business to prove it took all reasonable steps to stamp corruption out. Hospitality has been as particular feature of the publicity surrounding the Act—the law deals with both taking someone out and being entertained. It also governs your relationship with people you do business, including any referral fees you pay to get work in.
This webcast will give a practical, not academic, reminder of what the Act is about and the key areas of focus for businesses. It will look at the U.K.'s first prosecution under the Act and some likely areas of enforcement in the near term. We will work through the UK Government's Guidance on the planning a corporation needs to do to comply and will help you develop your action plan. We will also look at some significant topical events including some on-going U.K. corruption investigations and the debate around entertaining at the Olympics, F1 and Wimbledon.
