Duane Morris partner Sharon Caffrey will discuss "The Single Fiber/Any Exposure Theory of Causation In Asbestos Litigation and Beyond: Enough is Enough, but How Much is Enough?" on Monday, October 29, 2012 at the ABA's 7th Annual Chemical Products and Toxic Torts Regional Seminar.
The Annual Chemical Products and Toxic Torts Regional Seminar is held the by American Bar Association's Section of Litigation Products Liability and Mass Torts Committees and is co-sponsored by St. John's University School of Law. The seminar will begin on Monday, October 29, 2012 at 8:00 a.m. for registration and conclude at 3:00 p.m. Ms. Caffrey's session will run from 10:30 a.m. to 12:00 p.m. Duane Morris partner Beatrice O'Donnell will also serve as a co-chair for the Mass Tort Committee.
In recent years, asbestos personal injury cases have focused more and more upon dose, specifically how much is enough to cause disease and whether or not plaintiffs sufficiently demonstrate, both medically and scientifically, a link between the exposure and the alleged injury, and if the exposure itself caused the disease. Lawyers and experts continue to debate these questions and the validity of the “Single Fiber” or “Any Exposure” Theory. This panel will review the issues and related case law, help attendees sort through the current state of the law, as well as challenges to expert opinion, present experts to discuss the science and medicine of exposure and disease, and gather the information to help figure out how to address the question of “how much is enough?” and how to incorporate—or leave out—the issue.
