Duane Morris special counsel Michael Clark will speak on "Rules of Engagement: Legal Ethics Issues in Today’s Government Investigations" at the ABA's Health Law Section 10th Annual Washington Health Law Summit on Tuesday, December 4, 2012 in Washington, D.C.
The recent case of U.S. v. Stevens shone a new light on the duties of inside and outside counsel in responding to government investigations, illustrating the fine line that may separate "advice of counsel" from "alleged cover-up." At the same time, that case and other recent developments have raised new issues about the professional obligations of government lawyers in dealing with investigation targets and their counsel. This session will explore key ethics and professional responsibility issues that may arise in interactions between and among counsel in the context of investigations.
