Duane Morris partner Robert Hopkins will serve as a panelist discussing "Hot Topics in Maritime Litigation: Key Supreme Court and Circuit Court Cases, Emerging Trends and What to Expect in the Year Ahead" at the American Conference Institute's (ACI) 2nd Annual Forum on Admiralty & Maritime Litigation on Wednesday, February 27, 2013, in Houston.
"Hot Topics in Maritime Litigation: Key Supreme Court and Circuit Court Cases, Emerging Trends and What to Expect in the Year Ahead" will examine what may be ahead for maritime litigation in the upcoming year. Panelists will discuss recent and pending Supreme Court cases, and relevant issues including the status of a "vessel," liability for an injury unknown at the time of employment, and possible interpretations of the Outer Continental Shelf Lands Act. They will also take a look at the circuit courts and the scope of arbitration agreements and third-party rights and participation in arbitration.
The admiralty and maritime industry continues to evolve, creating complex issues in litigation and challenges in compliance. With environmental fallout and questions surrounding liability apportionment and emergency response stemming from recent catastrophes including the Costa Concordia, MSC Flaminia and Deepwater Horizon, procedural challenges, and complexities in insurance policies and coverage, defending and managing maritime claims is an uphill battle for defense attorneys. Additionally, with the law governing admiralty and maritime claims continuing to evolve and several pending Supreme Court cases on important maritime issues, there has never been a more important time to convene and exchange insights and strategies with colleagues and experts in the field.
