Our lawyers draft opinions regarding coverage obligations and pursue and defend declaratory judgment actions in state and federal courts. We are active in bar associations, defense organizations and committees on substantive and procedural aspects of the law that have an impact on the presentation of our clients' cases.
Products Liability and Toxic Torts. The firm has defended the manufacturers of a wide range of products, including drugs and vitamins, medical and orthopedic devices, hospital equipment, tires, wheel assemblies and other automotive components, cleansers, pesticides, construction equipment, ship turbines, helicopters, meat grinders, food products and processors, printing presses and asbestos-containing products. Premises Liability. In the field of premises liability, we have represented several nationally known business chains in defending the claims of business invitees and licensees ranging from minor accidents to serious injuries and death. We have also represented numerous small businesses and private individuals in premises liability claims. The firm also regularly defends recreational facilities, including ski areas and alpine and water slides, in personal injury actions.
Professional Liability. The firm defends numerous physicians and hospitals in malpractice cases. Such cases have involved not only a broad variety of complex medical issues, but also related issues such as appropriate venue in actions against hospitals and defending against the developing theories of "corporate liability" of hospitals.
The firm provides similar services to other professionals and advisers including accountants, agents and brokers.
Automobile Insurance Defense. Our automobile insurance defense practice encompasses not only the defense of automobile accident cases, but also the litigation of coverage questions and the defense of "first party" contractual disputes seeking insurance benefits. We have handled declaratory judgment suits for major insurance companies and insurance guaranty associations with issues ranging from fact questions affecting an individual policy to questions of policy language construction potentially affecting millions of claims. We have also investigated and defended cases involving alleged insurance fraud and bad faith claims.
