[ eDiscovery ]

On December 1, 2006, sweeping changes to the Federal Rules of Civil Procedure governing the discovery of electronically stored information, or "e-discovery," took effect. This means that every federal court case and many state court cases require attorneys to advise their adversaries of the details of their clients' electronic data and document management systems and, in many instances, to produce electronically stored information, including company e-mails. The amendments anticipate that most litigants already have in place a document retention policy that is followed by all people within the company.

How Duane Morris Can Help Companies Prepare for Imminent Changes

Duane Morris can provide a team - comprised of both attorneys and IT professionals - to evaluate on an individualized basis a company's internal electronic storage systems to determine what changes may need to be made in accordance with the new Federal Rules.

Diagnosis

We have developed a diagnostic questionnaire to help us learn a company's needs, policies and IT systems.

Analysis

We analyze the information gathered from meeting with a company representative to identify issues that may need to be addressed in light of changing Federal Rules and practices.

Meeting

We meet with legal staff, IT professionals and others affected by the changes to discuss solutions to issues that have been identified.
