Duane Morris represented more than 20 Pennsylvania health systems, comprising roughly 100 healthcare providers, in an action against the Pennsylvania Department of Public Welfare to obtain recovery on more than $54 million in claims owed to the providers by a defunct Medicaid health maintenance organization. The providers claimed that the DPW failed to properly oversee the HMO's operations and was liable for the providers' substantial losses on services rendered to Medicaid beneficiaries enrolled in the HMO. The action resulted in a substantial, multimillion dollar settlement prior to the final liquidation of the insolvent HMO. During a time when Medicaid monies are increasingly scarce, Duane Morris obtained a substantial recovery from the Medicaid program for Pennsylvania hospitals.

Our healthcare attorneys conducted a successful arbitration proceeding against a national managed care company on behalf of the Maine Health Alliance, a large network of physicians and hospitals. Working on a partial contingency fee basis, we recovered payments owed under the existing contract; negotiated a new, more favorable managed care contract with the payor; ensured ongoing audit procedures under the new contract; and preserved the ongoing relationship between our client and the payor.

Duane Morris assisted in the structuring and formation of Harvard Medical Faculty Physicians, the faculty practice plan at the Beth Israel Deaconess Medical Center in Boston that is affiliated with the Harvard Medical School. Duane Morris assisted ABE Briarwood Corp. in the acquisition of approximately 170 skilled nursing facilities in about 20 states from a bankrupt healthcare provider. Our client wanted to acquire and then net lease the nursing facilities to experienced operators. We advised ABE Briarwood and helped it achieve its desired result of obtaining all of the nursing facility licenses prior to the closing.
