FDA Will Not Implement User Fee Program for Advisory Review of Direct-to-Consumer Television Advertisements

On January 16, 2008, the Food and Drug Administration (FDA) announced that it will not implement the Direct-to-Consumer Television Advertising User Fee Program because the necessary user fees for the program were not provided for in the Consolidated Appropriations Act of 2008 that President Bush signed into law on December 26, 2007. The FDA has indicated it will not send invoices to any entity that had intended to participate in the user fee program. The FDA also has indicated that it will continue to review advertisements voluntarily submitted to the FDA in as timely a manner as resources will permit.
