Jennifer Philbrick McArdle is vice chair of the Commercial and Antitrust Litigation division of Duane Morris' Trial Practice Group. Ms. McArdle practices in the areas of commercial litigation and media and intellectual property law. Ms. McArdle has a broad range of business litigation experience, including in contract, tort, trade secrets, professional liability, insurance, securities, consumer fraud, and other areas of law. She counsels clients ranging from major financial institutions and Fortune 100 companies to startups and individuals on these matters, advocating in both state and federal court, as well as in arbitration and other alternative dispute resolution forums, and assisting with strategic decision-making outside of the litigation context. Ms. McArdle also regularly advises clients in connection with the drafting and negotiation of commercial contracts and in employment matters, particularly those involving restrictive covenant, confidentiality and intellectual property issues. 

Ms. McArdle also has significant experience in media and intellectual property law. She counsels clients in connection with copyright registration and litigation; pre-publication review; defamation claims; reporters’ rights issues; requests for information under state and federal freedom of information laws; claims under the Lanham Act; trademark prosecution; and practice before the Trademark Trial and Appeals Board.  She regularly represents corporations in the financial, media and publishing, entertainment, insurance, technology and consumer goods industries in these matters, as well as individuals.

Prior to entering the practice of law, Ms. McArdle served as judicial clerk to the Hon. Naomi Reice Buchwald of the U.S. District Court for the Southern District of New York. Ms. McArdle is a 2009 graduate of Columbia University School of Law, where she was a Harlan Fiske Stone Scholar and served as an editor of the Columbia Law Review and the American Constitution Society Moot Court program, and a cum laude graduate of Harvard University.
