Philadelphia Mayor Signs into Law Legislation to Ban Inquiries into Wage History

As we anticipated in our December 21, 2016 Alert, the City of Philadelphia has now become the first city in the nation to restrict employers from inquiring into an applicant’s wage history.

On January 23, 2017, Philadelphia Mayor Kenney signed the bill to amend the City’s Fair Practices Ordinance, which will take effect on May 23, 2017.  The Philadelphia City Council passed the bill in December 2016.  In the interim between the passing and signing of the bill, the City’s Law Department evaluated legal concerns that the business community raised about the bill.  In connection with signing the bill, Mayor Kenney released a statement expressing confidence in the City’s ability to prevail in any legal challenge to the law.
