Alessandra Mungioli is a senior trial attorney who represents clients across a variety of industries in complex commercial litigations as well as in high-value disputes in alternative resolution forums such as arbitrations and private mediations.

Ms. Mungioli frequently represents clients in the healthcare industry ranging from independent and specialty pharmacies, to hospital systems, pharmaceutical manufacturers and distributors, as well as a range of healthcare providers including physician groups, long term care facilities, and telehealth providers.  Ms. Mungioli has extensive experience litigating issues between payors and pharmacy benefit managers (PBMs), effectuating and challenging terminations from insurance and other business networks, and litigating high-value contract and business tort disputes.  Ms. Mungioli counsels clients on complex issues of statutory and regulatory compliance and routinely advises on effective dispute resolution strategies that she tailors to support each client’s unique needs.

In addition to her healthcare litigation practice, Ms. Mungioli is experienced in franchise matters, representing numerous franchisors and franchisees in termination disputes and in disagreements over non-competition provisions.  Additionally, she advises clients on business solutions that simultaneously support clients’ individual business needs and mitigate risks.

Ms. Mungioli has significant trial experience.  She has litigated matters to favorable jury verdicts, successfully argued case dispositive motions, cross-examined expert witnesses, and prepared both expert and lay witnesses for depositions and trial examinations.

Ms. Mungioli serves on the firm’s Associates Committee. Prior to joining Duane Morris, Ms. Mungioli served as law clerk to the Hon. Michael M. Baylson of the U.S. District Court for the Eastern District of Pennsylvania.  During her clerkship, Ms. Mungioli assisted Judge Baylson with numerous civil trials and drafted countless legal memoranda.

Ms. Mungioli is a 2019 graduate of the University of Pennsylvania Carey Law School, where she was Production Editor of the Journal of Business Law and Senior Executive Editor of the Journal of Law and Public Affairs.  Ms. Mungioli earned a Certificate in Management from The Wharton School and is a magna cum laude graduate of Drexel University, Pennoni Honors College, where she played on the varsity soccer team.

Representative Matters

  • Obtained order granting summary judgment to transportation solutions company based on the Graves Amendment, and further finding that a co-defendant was obligated to contractually indemnify our client for all losses.

  • Represented Virtua Health System and Our Lady of Lourdes Health System in commercial litigation brought by Deborah Heart & Lung Center in New Jersey state court whereby Deborah claimed that Virtua’s acquisition of Lourdes in 2019 caused Lourdes to breach a restrictive covenant in a contract between Deborah and Lourdes, and resulted in Virtua inducing the alleged breach and competing unfairly with Deborah. This matter was resolved by the mutual agreement of the parties and dismissed in its entirety with prejudice.
