Representative Matters
Represented a developer client against a general contractor in securing a settlement two days before trial, after eight years of litigation, two bankruptcy stays, consolidations and severances. The general contractor’s pre-trial damage disclosures and expert on damages claimed $8.3 million was owed, but the team argued this model and the contractor’s claim was flawed because their (multiple) mechanic’s lien claims were validly subordinated under Texas law or otherwise lacked the requisite substantiating proof to prevail at trial. Fearing an adverse fee award, the general contractor accepted a nominal $125,000 settlement offer and the case was dismissed.
