Representative Matters
Represented an insurer in obtaining a dismissal without leave to amend at the demurrer stage in a duty to defend declaratory relief action filed by the insured against several insurers. The demurrer argued that the complaint failed to allege an actual controversy between the client and the insured, and that the policy language required neither a duty to defend nor a duty to reimburse defense costs. Because the policies had been filed in the same court in a different case, the court was able to review them and make the determination at the pleading stage that there was no duty to defend or to reimburse defense costs absent consent of the client.
Successfully demurred to the entire complaint in a breach of fiduciary duty, negligent misrepresentation, and intentional misrepresentation case against a third-party administrator and employee; simultaneously successfully moved to strike punitive damages without leave to amend based on insufficient allegations for punitive damages sought relief.
