Pat Smith is a seasoned litigation and regulatory attorney with a special focus on real estate, land use and advertising issues relating to the out-of-home media business. Prior to joining Duane Morris, Mr. Smith was Senior Vice President at OUTFRONT Media, where he led the organization’s litigation, regulatory and insured matters remit, including counseling on risk assessment and dispute resolution, setting strategy for and overseeing all administrative and court matters, conducting settlement and mediation conferences, and handling court and administrative appearances for the company. He worked closely with the development team on risk mitigation and dispute resolution relating to P3 and construction projects. Mr. Smith also oversaw the company’s compliance program, which involved management of internal investigations and ethics training and reporting to the board of directors, senior management, and internal and independent auditors on compliance and litigation matters for one of North America’s largest public out-of-home advertising companies.

With deep knowledge of liability risks as well as the legal landscape relating to age-restricted and regulated products, including cannabis, gaming, pharmaceutical and political ads, Mr. Smith supported the senior sales and marketing teams to counsel advertisers and ensure the propriety of corporate communications and advertising copy. He has drafted, negotiated and managed disputes relating to contracts, leases, licenses, partnership agreements, NDAs and confidentiality agreements. Additionally, Mr. Smith worked as part of the company’s government affairs team and partnered with industry counterparts to advance positions on legislative initiatives, provide legal guidance on regulatory and constitutional challenges and advocate before governmental bodies and agencies.

Mr. Smith served as a law clerk to the Hon. Joseph M. McLaughlin of the U.S. Court of Appeals for the Second Circuit and is a graduate of St. John’s University School of Law (J.D., cum laude, 2006), where he was executive notes and comments editor of the St. John’s Law Review. He also was a graduate fellow at the American University (M.A., 2002) and graduated first in his class at St. John’s University (B.A., summa cum laude, 2000).
