Seth M. Rokosky is an appellate litigator with extensive experience handling complex commercial matters at both the trial and appellate levels.
Mr. Rokosky has conducted 30 oral arguments and filed more than 90 appellate briefs, including in the U.S. Supreme Court, U.S. Courts of Appeals, New York Court of Appeals, and other New York appellate courts. His experience includes affirmative and defensive appeals, emergency motions, stay applications, and amicus briefs, and it covers a wide range of subject matters such as commercial litigation, securities, insurance, antitrust, bankruptcy, RICO, intellectual property, class actions, administrative, civil, and criminal procedure, and constitutional law.
In the trial courts, Mr. Rokosky regularly serves as embedded appellate counsel, advising on strategy and briefing critical issues. His work includes drafting pleadings, motions, jury instructions, verdict forms, and pre- and post-trial submissions, as well as negotiating settlements. He has been an integral member of trial teams for clients across industries, including financial institutions, insurers, and multinational corporations.
Mr. Rokosky serves as Co-Chair of the Appellate Practice Committee of the New York State Bar Association’s Commercial and Federal Litigation Section, which was recognized in 2025 as “Practice Committee of the Year,” and he is Co-Chair of the Appellate Rules Subcommittee for the Appellate Practice Committee of the American Bar Association. He has also been recognized in Best Lawyers: Ones to Watch in America for Appellate Practice.
Committed to public service, Mr. Rokosky served as Assistant Solicitor General in the New York Attorney General’s Office’s Appeals and Opinions Bureau, where he represented the state and its agencies on a wide array of appellate matters. He also has received multiple awards for his pro bono work, including three Outstanding Service Awards from the Legal Aid Society for his representation of a class of disabled New Yorkers in the aftermath of Hurricane Sandy.
Mr. Rokosky clerked for the Honorable Thomas M. Hardiman on the U.S. Court of Appeals for the Third Circuit. He is a cum laude graduate of the University of Pennsylvania Law School, where he was a senior editor of the Penn Law Review and a legal writing instructor. He earned his undergraduate degrees, summa cum laude, in history and philosophy from the Ohio State University, where he graduated with honors and research distinction.
Outside the courtroom, Mr. Rokosky is an accomplished competitive chess player and a certified National Master by the United States Chess Federation. He has earned a national championship and numerous state championships.
