About the Program

The False Claims Act (FCA) provides the United States government with a primary investigative and enforcement tool for recipients of federal funds. Educational institutions have been an increasing focus of FCA investigative and enforcement efforts. The new administration has made plain that it intends to use the FCA aggressively to advance its policy goals. Understanding the FCA’s framework and its broad reach will be essential in evaluating compliance and risk moving forward. This program will provide a broad primer on the FCA, including:

  • The history and scope of the FCA along with the elements and basic theories of liability and damages under the FCA.
  • How FCA cases can originate against educational institutions, along with investigative tools utilized by the government.
  • How to respond to potential FCA issues and investigations.
  • Some potential FCA risk areas for educational institutions.
